REQUIREMENTS FOR AN EMPLOYMENT VISA

One (1) application form completed and signed by the applicant.

One (1) passport sized photograph affixed to the application form.

Passport

An authorization from the Ministry of Foreign Affairs in Saudi Arabia.

Medical Examination result given by a competent medical authority.

Letter from the sponsoring company, with the Block visa number and date

Copy of the signed employment contract with the company in Saudi Arabia

Police clearance certificate

Copies of the academic qualifications and work experience in the field of the job applied for.

A letter of No Objection or a Letter of Release from previous employer, if applicant has worked in Saudi Arabia.

Foreign workers in Saudi Arabia must present  the following documents to enter the country:

§   Passport  (valid for at least six (6) months)

§   Employment Visa

§   Health Certificate

Visa holders must arrive in the Kingdom within the period of validity of the visa, which starts on the date of issue.

Employment visas are valid for one (1) entry only, unless otherwise specified.

PROCEDURE FOR AGENCY HIRE

1.     Verify with POEA the agency license and job order

2.     Apply with the agency

3.     Undergo Medical Examination with DOH accredited clinics (3 days) (if selected)

4.     Attend the PDOS at an accredited provider (1 day) (while waiting for visa)

5.     Attend POEA Supplemental Briefing (1hr)

TERMS AND CONDITIONS OF EMPLOYMENT

The employer shall bear the costs of transporting and returning the worker from point of hire to worksite

The employer shall provide free of charge 3 meals a day

The employer shall also provide suitable living quarters.

Workers are required to surrender their passports to their employers.

A foreign worker should be under contract with and guaranteed by a Saudi employer, or a non-Saudi employer authorized under the Regulations of Foreign Capital.

The Labor Contract should be in writing, and drawn up in Arabic and in duplicate, one copy to be retained by each party.

The contract should be signed by the worker and the employer specifying the worker’s wage, job specification, and terms of employment.

The work week is from Saturday through Wednesday, with the weekend on Thursday and Friday.

Note: Friday is the Muslim holy day of the week. 

Regular working hours is 8 hours per day / 48 hours per week

Note: During Ramadan – not to exceed 6 hrs/day or 36 hrs/week exclusive of the intervals for prayer, rest and meals

Regular working hours may be raised to 9 hrs/day in certain categories (e.g. hotels, snack bars, restaurants)

Regular working hours may also be reduced in case of hazardous or harmful nature 

Overtime Pay of 150% is provided for work rendered on rest days and holidays

Overtime should note exceed 4 hours

Where the worker has completed 1 year service, he shall be entitled to an annual vacation leave of 15 days with full wages payable in advance.

After two (2) years of service, a worker is entitled to a one (1) month fully paid vacation leave.

Vacation leave shall be increased to 21 days where the worker has completed 10 continuous years of service

Employer shall grant worker sick leave with full pay for the first 30 days and ¾ pay for the next 60 days in any 1 year

Employees of firms with 10 or more workers are covered with Social Insurance

Foreign workers and their dependents are not entitled to free government heath care services.

Foreign workers do not file personal income tax

Foreign workers  cannot leave KSA without  their  employers consent.

An exit permit is required at the airport before one can leave the Kingdom. The exit visa is only issued upon the request of the Saudi sponsor.

An OFW can only re-enter the Kingdom after six(6) months from his last departure from the Kingdom.

If you pre-terminate your contract, you will have to wait for three (3) years before you are allowed to return to Saudi Arabia.

Employer shall grant worker sick leave with full pay for the first 30 days and ¾ pay for the next 60 days in any 1 year

Just causes for termination of contract:

§         §         Committed assault against the employer

§         §         Failure to fulfill the essential obligations arising from the contract or obey legitimate orders

§         §         Insubordination

§         §         Bad conduct affecting honesty or honor

§         §         Negligence with intent to cause damage/material loss to the employer

§         §         Misrepresentation/forgery to obtain the job

§         §         Absenteeism

§         §         Loss of confidence by the employer

Notes:   Labor Disputes are settled in Labor Courts or the High Committee for Settlement of Disputes (excluding Household workers)

Employment of foreign domestic helpers is not covered by the provisions of the Saudi Labor Law.

Female household workers should be at least twenty-one (21) years of age

COMMON PROBLEMS

In general, the present salary rate in Saudi Arabia is too low compared with the salary rates before.

However, workers in established companies (e.g. hospitals) generally enjoy higher wages compared to those working in small companies.

The former also enjoy good accommodation and  worksites with modern equipment, good lighting and ventilation, and safety devices while the later may not enjoy modern and adequate facilities and good accommodation.

IMPORTANT REMINDERS

Practicing religion publicly other than Islam is prohibited.

It is also prohibited to possess religious articles such as bible, crucifix, statues and other symbols.

During prayer time, restaurants, stores, and other public places close for approximately half an hour as the Muslims stop their activities.

Foreigners are advised to respect the observance of the Ramadan by not eating, drinking, smoking, chewing gum, etc. in public from dust till dawn.

The “IQAMA” or residence permits which serves as proof of legal residence in the country must be carried by the worker at all times.

Women are not allowed to interact with men other than their husbands.

Women are advised to wear their “abaya” when going out.  Wearing of pants is not also advisable.

Married couples should carry with them their marriage certificates when going out together.

Other forbidden items include mobile phones with built-in cameras, weapons, ammunition, pork and pornography.

Saudi law prohibits the sale or use of any alcoholic drink. Any gambling activity is likewise ban.

Public theatres and cinemas are prohibited.

Makkah and Madinah hold special religious significance and only persons of the Islamic faith are allowed entry.

Taking photographs of mosques, airports and military installations without permission is not allowed.

Before entering a house of a Saudi, you should stand at the door in such a way you cannot see the inside.  You can only enter when your host has signaled you by extending his right hand, palm up, and said “Tafaddal”, or "Come in".

Involving in illicit drug activities is strictly prohibited. Using prohibited drugs is punishable by imprisonment while smuggling or trafficking is punishable by death.

Prescription drugs must be documented.

CRIMES & PUNISHMENTS  

Hadd are crimes against the divine commandments like highway robbery, murder, theft, adultery, apostasy, and intoxication. 

Punishments: amputation of body parts or worst, execution

Ta’zir are crimes against the community

Punishments: fines, imprisonment and whipping 

Qisas are crimes against a person which allows the victim of his kin to seek retribution. 

Punishments:  inflicting the same harm on the criminal – death for death.

** The harm may also be paid for in money form, called “blood money”, if the victim or his keen agrees.  

***These crimes are tried by the Sharia Courts.

Clothing

Women Wear. . .

CAFTAN which is a full-length, loose robe with long sleeves.

When going outside the house, they  add an outer garment called an “abaya”.

They also use veils to cover their hair in public and a mask (called a burka or batula) to cover their faces.

Men Wear. . .

“THOB”, similar to the caftan. Over the thob they wear an “aba” or “bisht”, a coarser robe usually of brown wool.

The head covering is a small skullcap, and a large square kerchief called a “ghoutra”.

The ghoutra is held in place with an “igal”, a two intertwined black cords formed into rings.

THE SAUDI FOOD

Consists of rice with mildly spiced lamb or chicken, dates and milk products.

They traditionally eat with their fingers while sitting cross-legged on the floor. Banquets are usually served on the floor covered with rugs.

Coffee, tea, buttermilk cola and the camel’s milk called “laban” are the popular beverages.

Generally, they take little food during the day and have their main meal in the evening. 

During the month of Ramadan, all Muslims abstain from food during the daylight hours.

The Government

MONARCHY headed by KING FAHD BIN ABDUL AZIZ as the King & Religious Leader.  He is also the custodian of the Two Holy Mosques. 

 The nation has no constitution but is governed through the principles of Shari'ah, Islamic law as prescribed by the Qur'an, the holy book of Islam.

The Economy

Oil-based economy with strong government controls over major economic activities.

  Major Industries are crude oil production, petroleum refining, cement, construction, fertilizer and plastics.

  Saudi coins are called “halalahs.”

TRANSPORTATION & COMMUNICATION SYSTEM

The Kingdom has a network of roads including an extensive expressway system.  It is the only country in the Arabian Peninsula that has a rail system.

Saudi Arabia Public Transport Company (SAPTCO) operates the country's inter-city and intra-city bus service. SAPTCO buses are used in going around the country.  Taxicabs are available but not metered.

Saudia Airlines is the national flag carrier.  Its international flights serve destinations all over the world and a domestic network covering the country.

There are 3 international and 22 domestic airports in Saudi Arabia. 

There are modern seaports and oil terminals on the Red Sea and on the Arabian Gulf.

Telephone landlines & mobile cellular phones with Direct Dialing systems, and internet service provides are available. 

Newspapers, magazines and radio and television programs are available in Arabic and English.
